Subletting or transferring the rented holiday apartment and its use for purposes other than residential requires prior written consent from us. Terms and conditions of the guest apply only if previously agreed upon. Deviations from these conditions are only effective if we have expressly confirmed this in writing. § 1 Booking/Booking Confirmation All booking inquiries can be made via our website www.cabinwesterwald.de, by email mail@cabinwesterwald.de or by phone at +491704566553. If we can offer you the holiday apartment in your desired time frame, we will send you a written confirmation by email. With the receipt of the booking confirmation and after the down payment has been made (see § 3 Payment Terms), your booking becomes legally binding. § 2 Payment Terms The booking becomes valid upon receipt of the down payment. The down payment of €150 is due within 5 days after booking. After the down payment has been made, the payment of the remaining amount is due no later than 20 days before the start of the trip. If the payment deadlines are not met, CabinWesterwald can withdraw from the contract. Non-payment is considered as withdrawal and entitles us to re-rent the property. Additional costs for water, parking space, electricity, Wi-Fi, and waste are not charged. § 3 Arrival and Departure On the day of arrival, the holiday apartment is available from 2:00 p.m. The information for accessing the house will be provided to the guest in the digital guest folder. Claims for damages cannot be asserted if the holiday apartment cannot exceptionally be accessed on time at 2:00 p.m. On the day of departure, the apartment must be vacated by 10:00 a.m. If the guest wishes to leave late, this must be discussed with us in advance. A late departure without prior consultation will be charged. If the guest does not arrive by 8:00 p.m. on the day of arrival, the contract is considered canceled without notification to CabinWesterwald. CabinWesterwald can then freely dispose of the property. A (proportional) refund of the rent due to early departure is generally not granted. The apartment must be left broom-clean on the day of departure. Dishes, glasses, etc. must be cleaned and put away, bins must be emptied, and the refrigerator must be cleared out. If the apartment is not left as requested, this may be charged to you (minimum fee for increased cleaning effort: €50.00). § 4 Holiday Apartment The holiday apartment will be handed over by us in a tidy and clean condition with complete inventory. Should you notice any defects during your stay, the guest is obliged to inform CabinWesterwald immediately. The guest is liable for any damages caused by him to the rental property, the inventory (e.g., broken dishes, damage to the floor or furniture). This also includes the costs for lost keys. The inventory must be treated gently and carefully and is only intended for use in the holiday apartments. Rearranging furniture is not allowed. The guest is also liable for the fault of his accompanying travelers. In case of improper use of the holiday apartment, such as subletting, over-occupancy, disturbance of the peace, etc., the contract can be terminated without notice, and the guest must leave the holiday apartment. The rent already paid remains with CabinWesterwald. § 5 Pets The accommodation of pets of any kind in the holiday apartment is only allowed with prior written consent of the provider and payment. A reasonable surcharge per booking will be charged for accommodating pets. If animals are accommodated without prior consent from the provider, a cleaning fee of at least €50.00 may be charged. § 6 Stay The holiday apartment may only be used by the persons listed in the booking. If the apartment is used by more persons than agreed, CabinWesterwald has the right to charge an additional fee of at least €50.00. Subletting and transferring the apartment to third parties is not allowed. The guest agrees to the General Terms and Conditions as well as the house rules of the holiday apartments. Consent is given upon payment. In case of violations of the GTC or house rules, CabinWesterwald is entitled to charge additional fees. There is no legal claim to a refund of the rent or compensation. § 7 Travel Cancellation In case of cancellation, the guest may be obliged to pay a part of the agreed price as compensation. A cancellation must be made in writing. The amount of compensation depends on the time until the arrival date and is as follows: up to 21 days before the arrival date: free of charge. 20 to 1 day before the arrival date 50 % of the agreed price. No-show: 100% of the agreed price. In case of cancellation, the costs for any sauna usage pre-booked in advance or a dog fee will be refunded. Cleaning fees (final cleaning) will not be refunded. § 8 Cancellation by the Landlord In the event of a cancellation on our part due to force majeure or other unforeseeable circumstances (such as in case of an accident or illness of the hosts) as well as other circumstances beyond our control that make fulfillment impossible; the liability is limited to the reimbursement of costs. In the case of a legitimate withdrawal, there is no claim for damages for the customer – liability for travel and hotel costs will not be assumed. A withdrawal by CabinWesterwald can occur after the start of the rental without notice. § 9 Liability of the Landlord CabinWesterwald is liable within the scope of due diligence for the proper provision of the rental property. Liability for any failures or disruptions in water or electricity supply, as well as events and consequences due to force majeure, is hereby excluded. § 10 Permission to Use Internet Access via Wi-Fi CabinWesterwald maintains internet access via Wi-Fi in its holiday apartment. It permits the guest to use the Wi-Fi access to the internet for the duration of his stay in the holiday property. The tenant does not have the right to allow third parties to use the Wi-Fi. CabinWesterwald does not guarantee the actual availability, suitability, or reliability of the internet access for any purpose. It is entitled at any time to allow additional users for the operation of the Wi-Fi entirely, partially, or temporarily and to restrict or exclude the tenant's access in whole, in part, or temporarily if the connection is misused or has been misused, as long as CabinWesterwald must fear a claim because of this and cannot prevent this with reasonable and customary effort in a reasonable time. In particular, CabinWesterwald reserves the right to block access to certain pages or services via the Wi-Fi (e.g., violent, pornographic, or paid sites) at its reasonable discretion and at any time. § 10.1 Access Data The use of Wi-Fi is secured by access protection. The access data (login and password) may in no case be passed on to third parties. If the guest wishes to grant third parties access to the internet via Wi-Fi, this is strictly dependent on previous written consent from us and documented acceptance of the regulations of this usage agreement by the third party with signature and full identification details. The guest agrees to keep his access data confidential. CabinWesterwald has the right to change access codes at any time. § 10.2 Risks of Using Wi-Fi. Limitation of Liability The guest is informed that the Wi-Fi only allows access to the internet; virus protection and firewall are not provided. The data traffic conducted while using the Wi-Fi is unencrypted. Therefore, the data may potentially be viewed by third parties. CabinWesterwald expressly points out that there is a risk that malware (e.g., viruses, Trojans, worms, etc.) can enter the device during the use of the Wi-Fi. The use of the Wi-Fi is at the guest's own risk. For damage to the digital media of the tenant that arises from the use of the internet access, we assume no liability unless the damages were caused by us and/or our vicarious agents intentionally or with gross negligence. § 11 House Rules, General Rights and Obligations (1) The guest is obliged to comply with the house rules. From 10:00 p.m. to 6:00 a.m., the night rest period applies. To avoid disturbances, video and audio devices must be set to room volume. (2) For the duration of the transfer of the holiday apartment, the guest is obliged to keep windows (except tilted) and doors closed when leaving the holiday apartment. (3) A general smoking ban applies in the holiday apartment. For violations, a cleaning fee of at least €150.00 may be charged. Smoking is also prohibited on the terrace and throughout the property. (4) The insertion or attachment of materials for decoration or similar is not allowed in the holiday apartment. The guest is solely responsible for any decorations that have been inserted and/or attached. The guest is also obliged to compensate for damages caused by the insertion and/or attachment of decorations. (5) CabinWesterwald has the right to access the holiday apartment at any time, especially in cases of imminent danger. The guest's legitimate interests will be adequately taken into account when exercising the right of access. We will inform the guest about the exercise of the right of access in advance unless this is unreasonable or impossible for him under the circumstances of the individual case. § 12 Jurisdiction For any disputes arising from the contractual relationship, the District Court of Betzdorf is responsible.
